The proposal and the sale on the website "www.loomfairtrade.org" integrate a distance contract governed by Articles. 50 ss. of Legislative Decree 6 September 2005, n. 206 (Consumer Code) and by Legislative Decree No 9 April 2003. 70 (cd. Law on Electronic Commerce). The purchase of products is intended for consumers and retailers. These Conditions of Sale govern the relationship between the customer and Loomfairtrade to purchase product/s marketed by Loomfairtrade quoted on website www.loomfairtrade.org. The customer is required to read the terms and conditions of sale that Loomfairtrade put at his disposal in order to enable the playback and storing the Conditions in compliance with art. 12 - com. 3rd Legislative Decree. N. 70/2003.
2. How to buy
To purchase the customer must select the product/s and add/in the Cart, the customer has to register by entering his personal details, following directions, presented by the recording program and must complete the appropriate form of payment in electronic format reported on the website. The forms must be completed in their entirety.
If the customer need to amend the purchase order and the data on it before the payment process, he has the ability to edit the product, the amount of the product/s to be purchased by tackling products in Shopping Cart . After this operation, the customer may update the summary of the purchase order, including the costs of delivery, and confirm the purchase proceeding to the next step "Checkout". The customer will have to enter the data related to shipping, billing and select the type of payment. If the customer select to pay by credit card, will be directed to paypall screen for entering data on the credit card.
Warning: The products are described in detail stating the name of the model, the size, the materials used and the color. The picture accompanying the color and product photos are purely descriptive and color of the product may be different from that represented by the monitor of your computer also due to the unique calibration configured by the user's PC. Therefore Loom Soc Coop is not responsible of any color difference between actual product received and product image reproduced from the screen, despite what the customer can exercise the right to return the product following the procedures and terms in this document.
3. Conclusion of contract
The order confirmation by Loomfairtrade sent to you at the email address provided, constitute acceptance of the contract proposal by Loomfairtrade. The contract will be concluded and will be binding on both parties. This order confirmation sent by Email from Loomfairtrade include a mention of the product/s purchased; the indication of the price and delivery costs. Customer can check at any time the content of the purchase contracts concluded using the "order status" which will allow access to their historical archives.
Product prices are expressed in Euro. The price of the product will be indicated on the site at the time of the order. They can not, therefore, be relevant any increases or decreases in the price, even in correlation to sales promotions before or after the purchase order. The Customer may pay by credit card VISA, MASTERCARD, MAESTRO, AMERICAN EXPRESS or PayPal providing the requested data to be managed directly by the banks issuing credit cards. The information will be encrypted using encryption systems that prevent the use by third parties. Once complete, if the latter is successful, the payment system will send an email to the customer confirming the transaction and Loomfairtrade an email authorization to delivery. To retailers will be able to pay by bank immediately (which entitles you to a 5% discount) or 60 days.
5. Delivery of products, and related timing
The delivery of the product/s will be sent by courier CLP Arezzo - SDA; the times will vary depending on the destination, the time when the order will be acquired and the availability of the product. For the goods available Loomfairtrade will deliver to the Courier CLP-SDA within 4 working days of receipt of the purchase order. Barring unforeseen circumstances and/or force majeure, the delivery throughout the country (except for the smaller islands and remote areas) will be equal to a maximum of 4 working days from delivery to the courier. On receipt of the product the Customer must verify that the carton is tightly closed and seal intact.
Customers are advised to NOT pick up the package if it is not whole. The Customer shall immediately report the problem to the courier CLP Arezzo - SDA; otherwise, the product/s will be considered regularly delivered. In the absence of the customer, the courier will leave a card (notice of passage) with instructions for delivery within 24 hours or with indications for collection at the post office. Following the next 48 hours there will be by the Courier CLP SDA another delivery attempt and one telephone contact. After this time the package will fall automatically in the warehouses of Loomfairtrade.
6. Guarantees and defective products
Products purchased from the site "www.Loomfairtrade.org" are subject to discipline, as applicable, under Articles. 128 et seq. Legislative Decree no. 206/05 on sales contracts and warranties for consumer goods. This guarantee will apply to the product that present lack of conformity and/or malfunctions not evident at the time of purchase, provided the product is used properly and with due diligence and in accordance with its intended use and as provided in the any technical documentation, compliance with the various operating rules therein. In case of detection of defects the cost of returning the product/s to our warehouse, whether by courier or postal service, is the responsibility of the customer. Seller shall not be held liable in the event of loss of returned products, shipping to incorrect addresses or delays in the delivery of products made on the understanding that the customer assumes all risk of such an expedition.
In case you requested a change-merchandise the new product will be shipped only after we received the original, and we will have completed and verified. Shipping costs and sending the exchange of goods are charged Loomfairtrade.
7. Right of withdrawal
Pursuant to the purposes of articles. 64 et seq. Legislative Decree no. 206/05 the customer can exercise the right of withdrawal, without penalty and without specifying the reason. The customer will has to follow this procedure:
a) communicate via e-mail that he wants to make the return to the address firstname.lastname@example.org specifying the order number and the products that he intends to return;
b) Provide, using a courier of his choice, shipping the product/s to our warehouse Loom Soc. Coop. Via de Trionfo, 67 - 52100 Arezzo (AR) Italy T. 3494219887, carefully packed and in the original packing box. Loomfaitrade will, by crediting a PayPal account, or bank to only reimburse the cost of the product/s mentioned in the purchase order, net of shipping. The shipment is the responsibility of the customer. The exercise of the right of withdrawal will be ineffective if the product is not returned intact, or missing the packaging of the product, or for the absence of integral elements of the product or damage to the product for reasons other than transportation. Moreover, for technical reasons related to the normal intended use of the products, the products themselves will not have to be worn, used, washed or damaged. The returned products must be sent to Loomfaitrade in a single shipment. Loomfaitrade reserves the right not to accept the heads of the same order returned and delivered at different times. And it is possible to request the change of color and/or pattern of product/s bought in the same manner explained above and on the same form indicating the model and the color that you require replacing. Loomfaitrade will exchange once it is ascertained that the product/s made are intact, packed in the original packaging. If the replacement product has a price higher than the previous, the customer is required to pay the difference by contacting Loom Soc Coop number t. + 39-3494219887.
Loomfaitrade collects and processes its data solely to provide information about our company and for the provision of its services and improving the quality of services. The processing of your data for the aforementioned purposes will be mainly using automated and computerized, for the time necessary to achieve the purposes for which they are collected, always respecting the rules of confidentiality and security required by law. The data will be processed by employees and/or professionals hired by Loomfaitrade, who carry out their activities under the direct supervision and responsibility of the company itself. Providing your personal data to Loomfaitrade is entirely optional and any refusal has no consequences except of course the impossibility of being able to provide on-line information and services that we require. The data, or some of them, may be disclosed to: (i) persons companies or professional offices who carry out assistance and advice to Loomfaitrade, with special but not exclusive reference to the issues in accounting, administrative, legal, tax and financial ; - Individuals who are authorized to access the data is recognized by law or by order of the authorities; (ii) parties delegated and/or engaged by Loomfaitrade carry out activities related to the delivery of IT services. Your information will not be disseminated or via the Internet or by other means.
