The proposal and sale on the website "www.loomfairtrade.org" integrate a distance contract governed by Articles. 50 et seq. of Legislative Decree September 6, 2005, n. 206 (Consumer Code), as well as Legislative Decree April 9, 2003 n. 70 (so-called Law on Electronic Commerce). The purchase of products is intended for consumers and retailers. These General Terms and Conditions of Sale govern the relationship between the Customer and Loom fair trade for the purchase of Products marketed by Loom fair trade on the aforementioned website www.loomfairtrade.org. The Customer is required to read carefully the terms and conditions of sale that Loom fair trade has made available in order to allow the latter to reproduce and store the Conditions in accordance with the provisions of art. 12 - com. 3° D. Legislative Decree no. 70/2003.
2. Methods of purchase
To proceed with the purchase, the Customer must select the Product(s) and insert them in the Shopping Cart, proceed with the registration by entering their personal details, following the instructions, presented by the registration program, must fill out the appropriate payment form in electronic format on the site. The forms must be completed in their entirety. If the Customer needs to modify the purchase order and the data contained therein before the payment procedure, he will have the opportunity to modify the Product(s) or the quantity of the Product(s) he intends to purchase by intervening on the Products in the Shopping Cart. 3. Conclusion of contract
The order confirmation with the pro-forma invoice from Loom fair trade sent to the Customer at the e-mail address indicated shall constitute acceptance of the contractual proposal by Loom fair trade. The contract shall be deemed to have been concluded and shall be binding on both parties. This order confirmation sent by Email from Loom fair trade shall contain the indication of the Product(s) purchased; the indication of the price and delivery costs. The Customer may check at any time the content of the purchase contracts concluded by using the "order status" function which will allow him to access his historical archive.
4. Methods of payment
The prices of the Products are expressed in Euro. The price of the Product will be the one indicated on the website at the time of ordering. Therefore, any price increase or decrease, even in relation to promotional sales prior to or subsequent to the purchase order, shall not be relevant. The Customer may pay by bank transfer or PayPal by providing the requested data that will be handled directly by the institutions issuing the credit cards. The information will be encrypted through the use of encryption systems that prevent its use by third parties. The delivery of the Product(s) will be carried out by Corriere Poste Italiane - SDA or GLS; the times will vary according to the destination, the moment in which the order will be acquired and the availability of the Product(s) itself. For the available goods Loom fair trade will deliver to the Courier within 3 working days after receipt of the purchase order. Except for unforeseen circumstances and/or force majeure, delivery times on the national territory (with the exception of the smaller islands and disadvantaged areas) will be equal to a maximum of 4 working days from delivery to the Courier. Upon receipt of the Product(s), the Customer must verify that the package is perfectly closed and the seal intact. Customers are invited not to collect the package if it is NOT intact. The Customer shall immediately report any complaints to the SDA Courier; otherwise, the Product(s) shall be deemed to have been duly delivered. In case of absence of the customer, the courier will leave a postcard (notice of passage) with instructions for return within 24 hours or with instructions for collection at the post office. Then, within the next 48 hours, the SDA Courier will make a further attempt to deliver the goods and make a telephone contact. After this time the package will automatically return to the warehouses of Loom fair trade.
6. Warranties and defective products
The products purchased from the site "www.Loomfairtrade.org" are subject to the discipline, as applicable, referred to in Articles. 128 et seq. Legislative Decree 206/05 on sales contracts and guarantees for consumer goods. This warranty will apply to the Product that presents conformity defects and/or malfunctions not found at the time of purchase, provided that the Product itself is used correctly and with due diligence, i.e. in compliance with its intended use and as provided for in any technical documentation, with compliance with the various operating rules indicated therein. In the event of a defect, the cost of returning the product(s) to our warehouse, either by courier or postal service, shall be borne exclusively by the customer. The Seller shall not be held liable in the event of loss of returned products, shipments to incorrect addresses or delays in the delivery of returned products, it being understood that the customer assumes all risk of such shipment.
In the event that a change of goods is requested, the new product will be shipped only after we have received the original and we have verified the conditions. The shipping costs and the cost of sending the exchange goods are to be borne by Loom fair trade.
7. Right of withdrawal
Pursuant to and for the purposes of Articles 64 et seq. D. Legislative Decree no. 206/05 the customer may exercise the right of withdrawal, without penalty and without specifying the reason. The customer must follow this procedure: a) Communicate by e-mail that you intend to return the goods to email@example.com specifying the order number and the items you intend to return;
b) Provide, using a courier of your choice, the shipment of the product(s) to our warehouse Loom Soc. The returned Products must be sent to Loom fair trade in a single shipment. Loom fair trade reserves the right not to accept items of the same order returned and shipped at different times. It is possible to request a change in the colour and/or model of the Product(s) purchased in the same way as explained above and indicating on the same form the model and the colour that is requested as a replacement. Loom fair trade will proceed with the replacement once it has ascertained that the returned Product(s) are/are intact and packed in the original packaging.
